Immigration evaluations play a crucial role in hardship waiver and cancellation of removal cases. These evaluations are vital for demonstrating the emotional and psychological challenges an individual and their family may face if they are removed from the U.S. Ultimately, they help immigration courts make informed decisions regarding the individual's ability to remain in the country.

There are several different types of immigration evaluations. Your attorney will tell you which type you need. At Element Counseling, we offer evaluations for Hardship Waivers and Cancellation of Removal.
Hardship Waiver & Cancellation of Removal
What is it?
A hardship waiver or cancellation of removal evaluation is a kind of assessment done by a qualified professional to evaluate a person's mental health in relation to immigration matters. It typically involves an interview and brief assessments and can support immigration applications or appeals, particularly in challenging situations. The process of evaluation aims to predict the hardship or psychological distress that would be experienced by a US citizen as a result of the removal of the non-permanent resident relative from the US.
What is the evaluation process like?
1. Initial Consultation - You will meet with your provide to review the type of evaluation you are seeking, provide a detailed overview of the process and answer any questions you may have.
2. Interview - Your provider will conduct an in-depth interview process designed to be more of a conversation. The goal of this discussion is to gain a better understanding of how the immigration process, potential separation, or relocation may impact you and your family. This process typically takes approximately 2-3 hours. We may also administer brief assessments during this time to help gain a better understanding of the emotional or psychological impact to the individual.

We will also discuss any details that are especially relevant to your case, according to your attorney.​

3. Follow-Up Session - A follow-up session may be scheduled to answer any clarifying questions and ensure accuracy of our understanding of your circumstances.
4. Report - A comprehensive and detailed report will be provided to your legal representation or attorney within two weeks of completing your interview.
What does it cost?
The cost for an evaluation is $800. This includes the consultation, interview, assessments, report writing, and coordination with your attorney.
Court Cost - If the provider is required to be in court, time preparing and in court will also cost $150 per hour. If a provider is required in court, there is a mandatory deposit of 4 hours of time ($600) that will be taken 7 days in advance of going to court. This is non-refundable. If your court case day is moved, please let them know with as much notice as possible so they can attempt to accommodate your request.
